The use of alternative ways of resolving criminal law conflicts in Kazakhstan

Abstract

In this article, the author, speaking in general about the positive introduction of restorative justice in Kazakhstan's legal proceedings, dwells on mediation as one alternative means of reconciliation in the criminal process. Mediation in the criminal process is applied in practice less often than in civil cases. Author gives his own reasons for the stage-by-stage compensation of harm to the victim, the responsibility for non-fulfillment of the mediation agreement, raises the question of costs of mediator services. The author substantiates the proposals on the improvement of mediation in the criminal process, aimed at its strengthening and expansion of application.
