Проблемы модернизации судебно-правовой системы России в 1860-е гг. (на материалах работы Г.А. Джаншиева «Основы судебной реформы»)

Abstract

В статье представлен процесс движения России по пути совершенствования таких существенных сторон судебно-правовой системы, как установление справедливого и объективного суда, отделение судебной власти от административной и учреждение независимых от администрации судебных учреждений. Отмечается, что в результате серьезной разработки, множества споров и противоречий в 1864 г. в России появился самый прогрессивный суд за всю ее историю. Однако, как убедительно показано в работе известного исследователя судебной реформы Г.А. Джаншиева, в условиях самодержавной монархии он не мог проявить себя в полной мере и уже после вступления в силу Судебных Уставов имели место препятствия их правильному действию. = The article presents the process of Russia moving along the path of improving such essential aspects of the judicial system as establishing a fair and objective court, separating the judiciary from the administrative and establishing judicial institutions independent of the administration. It is noted that as a result of serious development, many disputes and contradictions in 1864, the most progressive court in its history appeared in Russia. However, as convincingly shown in the work of the famous researcher of judicial reform G.A. Dzhanshiev, under the conditions of the autocratic monarchy, he could not prove himself fully and already after the entry into force of the Judicial Charter, there were obstacles to their correct operation.
